Terms of Sales
PREAMBLE
These conditions are concluded between, on the one hand, the company DENAIVE DIFFUSION, SARL - SIRET: 44309987400028 - with a share capital of 7500 euros - NII FR91443099874 hereinafter referred to as "Dominique DENAIVE" and, on the other hand, persons wishing to make a purchase via the e-commerce website of www.denaive.com, hereinafter referred to as “the User”.
For the application of these presents, it is agreed that the User and Dominique DENAIVE will be collectively referred to as the “Parties” and individually referred to as “Party”, and that the User having validated an order will then be referred to as “Buyer”. The rights and obligations of the User necessarily apply to the Buyer.
The User who would like to buy on the Site, declares to have full legal capacity and declares to have read the conditions of sale and accepted the rights and obligations relating thereto.
Any order for a Product offered on the Site assumes consultation and express acceptance of these general conditions of sale, without however this acceptance being conditioned by a handwritten signature on the part of the User. In accordance with the legal provisions, it is recalled that the validation of the order form as specified in article 3 below, constitutes an electronic signature which has, between the Parties, the same value as a handwritten signature and is worth proof of the entire order and the payment of the sums due in execution of the said order.
These General Terms and Conditions of Sale may be kept by any visitor to this site, either by printing them out or by computer recording them, in accordance with the provisions of article 1369-1 of the Civil Code.
ITEM 1: SUBJECT
The general conditions of sale are intended to define the reciprocal contractual commitments of each of the parties on the Internet network, thus allowing the regulation of the various stages of the online ordering process, order tracking and terms of use of this Site.
The Parties agree that their relations will be governed exclusively by this contract and the specific delivery and return conditions presented under the “delivery” tab. These are subject to change and updates, the conditions applicable to the order of an item by a customer are only those in force on the day of the order.
If a condition were to be lacking, it would be considered to be governed by the practices in force in the distance selling sector whose companies are headquartered in France.
ARTICLE 2: THE ARTICLES
The purpose of these general conditions of sale is to define, exclusively on the basis of the relationships they establish on the Internet, the rights and obligations of the Parties arising from the online sale of the Products offered on the Site. They regulate all the steps necessary for placing the order and ensure the follow-up of this order between the Contracting Parties
www.denaive.com is a site aimed at consumers, aiming to offer for sale, at retail price, high quality jewellery. The items on the Site are available while stocks last.
The products offered for sale on the site are subject to the warranty conditions provided for by law, and in particular Articles L. 211-4, L 211-5 and L 211-12 of the Consumer Code as well as the Articles 1641 and 1648, first paragraph, of the Civil Code as set out in the appendix.
The company cannot in any way guarantee the maintenance and availability of products for sale during any given period
The company cannot be held responsible for the non-performance of the contract concluded in the event of out of stock or unavailability of the product, force majeure, disruption or total or partial strike, in particular of the postal services and means of transport and/ or communications, flood, fire. In the same way, goods traveling at the risk and peril of the recipient cannot be held responsible for any loss or damage occurring during transport.
ARTICLE 3: PRICE AND PAYMENT
The displayed prices are displayed in euros, all taxes included. The amount of the delivery costs will be automatically displayed during the validation of the order.
When the customer receives his delivery, Dominique DENAIVE undertakes to send a detailed invoice which includes the price of the items and as well as the delivery costs, in accordance with article L 121 – 18 of the order code.
Payment for purchases is made only by credit card. Credit cards accepted are: Visa, Mastercard and American Express.
The electronic certificate issued by the secure electronic payment manager will serve as proof of the amount and date of the transaction, in accordance with the provisions of articles 1316 and following of the Civil Code.
In case of refusal of payment, the customer's order will be canceled.
ARTICLE 4: THE ORDER
To be able to place an order online, the customer must be of legal age, have legal capacity and hold a bank card.
However, if the order placed does not follow the correct progress of the steps governed by Dominique DENAIVE, for example an incorrect address, the company will inform the customer directly by email.
In order to place an order, the customer must follow several essential steps for the smooth running of the latter.
1st step; Choice, selection, validation and recording of items in the basket.
2th step: Verification of the items that have been selected (the order remains modifiable at any time).
3rd step: Order confirmation and validation.
From this moment on, the client shall;
– identify yourself using your profile created directly online including names, addresses (postal and email). The customer can choose his own delivery and billing address.
– To be able to pay, the customer must enter his credit card number as well as the expiration date and finally the associated cryptogram.
– In order to validate their order, the customer must click on the "pay now" button, which will authorize the immediate debit of the amount of the order placed.
Once this action has been taken, the customer will no longer be able to cancel his order and the contract will therefore be irrevocable unless the items are no longer available in stock.
ARTICLE 5: DELIVERY
Dominique DENAIVE delivers throughout France and worldwide.
The order will be shipped to the address indicated by the customer during his online identification and that his payment has been accepted. Dominique DENAIVE undertakes to send the order as soon as possible, within a maximum of 5 days. This period may be exceptionally extended to a maximum of 10 days during periods of annual leave or during exceptional periods of great affluence.
The shipment will be made by Colissimo, either at home with signature, or at a relay point.
Dominique DENAIVE also undertakes to deliver the packaged parcels in perfect condition and the customer must check the content and quality of his parcel himself before signing the receipt slip. In the event of a damaged or open parcel, the customer must report it to the courier and mention the damage observed.
The cost of delivery is a flat rate based on the first price bracket of Colissimo.
The shipping costs are free from 100 euros of purchase for a delivery in metropolitan France.
The shipping costs are free from 200 euros of purchase for a delivery in Europe, the DOM-TOMs and in the rest of the world.
